General Terms and Conditions of Sale (GTCS)
Article 1 - Purpose
These general terms and conditions of sale (GTCS) aim to define the terms of sale for products from the company ETABLISSEMENT CONSO (hereinafter referred to as "CONSO") on its website, https://conso-shop.com/ (hereinafter "the Site"), as well as the rights and obligations of the parties.
The following products, materials, equipment, accessories, spare parts will be referred to as ("Products").
These GTCS apply without restriction or reservation to all sales concluded by CONSO with its customers (hereinafter "the Buyer"). They prevail over any other version or contradictory document.
CONSO reserves the right to modify these GTCS at any time. The applicable GTCS are those in effect on the date of purchase.
Article 2 - Order
To order a product, the Buyer must create an account and follow the instructions on the Site.
The registration of an order becomes effective when the Buyer accepts these GTCS by checking the box provided for this purpose and validates their order. A confirmation email is sent.
In case of unavailability of a product after the validation of the order, CONSO will inform the Buyer by email and proceed with the refund of the concerned product.
CONSO reserves the right to cancel any order in case of a manifest error in the price of the product displayed on the Site.
Article 3 - Prices
The prices displayed on the Site are indicated in euros, inclusive of all taxes (VAT), excluding delivery charges.
Promotional offers are valid as long as they are displayed on the Site and within the limits of available stock.
The prices in effect at the time of purchase apply, and any subsequent modification of the price will have no effect on the validated order.
Article 4 - Payment Terms
Payment is due immediately upon validation of the order.
Accepted payment methods are:
- Credit cards (Visa, MasterCard, Maestro, JCB, Discover, American Express, Diner's Club, Union Pay)
- PayPal account
- Bank transfer
Payments are secured via the SSL protocol.
Article 5 - Delivery and Right of Withdrawal
5.1 Delivery
The maximum delivery time is 90 days from the order confirmation.
In accordance with Article L216-2 of the Consumer Code, the Buyer may request the cancellation of the order by registered letter if this deadline is exceeded. The refund will occur within 14 days.
The Buyer must check the condition of the package upon delivery and report any defects within 14 days.
5.2 Right of Withdrawal
The Buyer has a right of withdrawal of 14 calendar days from the date of delivery. They must notify their intention via their customer account or by email.
Return shipping costs are the responsibility of the Buyer.
The Buyer must return the product in its original, unused condition and in its original packaging to the following address: Établissement CONSO, 12 chemin de Saquier, 06200 Nice, France. Returns must be made exclusively to our postal address and not to a Collection Point (Point Relais).
The refund will be made within 14 days from the receipt of the returned products.
Article 6 - Transfer of Risks and Ownership
6.1 The transfer to the Buyer of the risks of loss and deterioration of the products will be made upon delivery and receipt of said products, regardless of the transfer of ownership, and regardless of the date of the order and payment thereof.
6.2 The transfer of ownership of the products, to the benefit of the Buyer, will only be made after full payment of the price by the latter, regardless of the delivery date of said products.
Article 7 - Warranties
7.1 The products sold by CONSO benefit from:
- The legal guarantee of conformity (Articles L217-4 and following of the Consumer Code)
- The guarantee against hidden defects
- The manufacturer's warranty
7.2 Exclusions of warranty: Any warranty is excluded in case of misuse, negligence, or lack of maintenance by the Buyer, as well as in case of normal wear and tear of the Product or force majeure.
Article 8 - Force Majeure
The Parties shall not be held liable if the non-performance or delay in performance of any of their obligations, as described herein, results from a case of force majeure, as defined in Article 1218 of the Civil Code.
The Party noting the event must immediately inform the other party of its inability to perform its service and justify it to the latter. The suspension of obligations cannot under any circumstances be a cause of liability for non-performance of the obligation in question, nor induce the payment of damages or late penalties.
The performance of the obligation is suspended for the duration of the force majeure if it is temporary.
Article 9 - Intellectual Property
CONSO remains the owner of all intellectual property rights on the photographs, presentations, studies, drawings, models, prototypes, etc., produced (even at the request of the Buyer) for the supply of products to the Buyer.
The Buyer is therefore prohibited from reproducing or exploiting said photographs, presentations, studies, drawings, models, and prototypes, etc., without the express, written, and prior authorization of CONSO, which may condition it on financial compensation.
Article 10 - Protection of Personal Data
In accordance with the General Data Protection Regulation (GDPR), CONSO is committed to protecting the personal data of Buyers. The collected data is used for order processing, commercial relationship management, and, if applicable, for direct marketing purposes.

Article 11 - Applicable Law and Language of the Contract
These GTCS are subject to French law and are written in French. In case of translation, only the French version shall prevail.
Article 12 - Disputes
Any dispute relating to the execution of an order and/or the interpretation of these general conditions is subject to French law.
In case of a dispute relating to the interpretation or execution of the agreements concluded between the Buyer and CONSO, an amicable solution will be sought before any legal action.
All disputes to which this contract and the resulting agreements may give rise, concerning their validity, interpretation, execution, termination, consequences, and consequences shall be submitted to the Commercial Court of Nice.
